A new federal lawsuit was filed in federal district court in San Diego today, announced two individual plaintiffs and the institutional parties to the case, advocacy organizations The Calguns Foundation (CGF), Firearms Policy Coalition (FPC), Firearms Policy Foundation (FPF), and Second Amendment Foundation (SAF). The case, captioned Jones, et al. v. California Attorney General Xavier Becerra, et al., challenges on Second Amendment grounds the State of California’s discriminatory age-based general ban on firearm purchases by legal, law-abiding adults over the age of 18 but under the age of 21. Attorneys Alan Gura and Donald Kilmer filed a petition for Supreme Court review in a federal Second and Fourteenth Amendment lawsuit challenging the State of California’s handgun roster and “microstamping” laws. The Calguns Foundation, an institutional plaintiff in the case, is joined by Second Amendment Foundation and four individuals.

A brief supporting Supreme Court review of a Fifth Circuit decision in a Second Amendment challenge to irrational federal gun control rules was filed by civil rights attorney Donald J. Kilmer, reports three constitutional rights advocacy groups who joined the brief.

Counsel for two individual California residents and five constitutional rights advocacy groups files a federal lawsuit challenging the State’s laws and policies that, they claim, prevent people from exercising their Second Amendment rights. Counsel for a Riverside County resident and five public interest litigation organizations filed a new motion to seek an injunction against Riverside, California Sheriff Stanley Sniff and the County of Riverside over a “discriminatory and unconstitutional” policy that prohibits legal U.S. residents from applying for a handgun carry license.

“Mr. van Nieuwenhuyzen has a fundamental human right to carry his gun outside his home for self-defense,
but Sheriff Sniff’s policies and practices prevent him from doing so. Those customs are our first target in
this case, and we look forward to forcing Sheriff Sniff to respect and follow the United States Constitution,”

Attorneys for seven California gun owners and four Second Amendment advocacy organizations announced today that they have filed an amended complaint and a new motion seeking a preliminary injunction in the civil rights lawsuit Sharp, et al. v. Attorney General Xavier Becerra, et al. over the California Department of Justice’s failures surrounding the ‘bullet button assault weapon’ registration program. Should any tyrants wish to chill or infringe the rights of the People, we would welcome the opportunity to defend freedom whenever, wherever, and however necessary. Hand-waving and hyperbole are not compelling government interests and censorship is not proper tailoring under the law.

“We’re suing because California DOJ’s Firearms Application Reporting System (CFARS) broke down during the deadline week for people to register their firearms in accordance with new state laws,” said SAF founder and Executive Vice President Alan M. Gottlieb. “For a whole week the system was largely inaccessible, so people who wanted to comply with the law simply couldn’t and now they face becoming criminals because they couldn’t do what the law requires.”
