You’re smart. You pay your taxes. You’re a good neighbor. You try your best to follow the law.
But in spite of these facts, the California government doesn’t trust you.
They think that the mere sight of a handgun advertisement on the exterior of a gun shop can trigger an otherwise reasonable person to barge in the store, obtain a firearm, and go on a violent rampage.
Considering that the state already uses background checks and a 10-day waiting period to prevent such a scary scenario, why do they continue to outlaw truthful, accurate advertising outside gun stores?
According to the California Penal Code § 26820, no images of handguns can be used in advertisements displayed outside a gun store. A gun store cannot even display a sign with the words “handguns for sale” on the exterior.
What?!
Do California lawmakers really think you have no self control? That you’ll let an advertisement dictate your behavior?
Apparently they do.
This anti-First Amendment law is the basis of Tracy Rifle & Pistol v. Harris, which seeks to strike down the state’s oppressive, outdated ban on handgun-related speech.
A federal judge denied the Plaintiff’s request for a preliminary injunction, but stated in his order:
“On balance – based on the arguments and evidence currently before the Court – the Court also finds it is more likely than not that Plaintiffs will succeed on the merits of their First Amendment claim.”
This terrifies Kamala Harris and her freedom-loathing cronies.
The Calguns Foundation has joined with other groups to support the Plaintiffs in this important case, which is still in the discovery phase. Multiple depositions – which will cost thousands of dollars each – are scheduled this fall.
